Terms & Conditions
These Terms & Conditions govern the use of OffshoreDedi hosting, server, domain and related services. They are intended to explain customer responsibilities, billing rules, acceptable use, service limitations and the conditions under which OffshoreDedi may suspend or terminate a service.
About These Terms
These Terms & Conditions form an agreement between OffshoreDedi and the customer using or purchasing an OffshoreDedi service.
These Terms apply to hosting services, virtual private servers, dedicated servers, specialized infrastructure, domain services, managed hosting, software licenses and related services supplied through OffshoreDedi.
By ordering, accessing or continuing to use a service, the customer agrees to these Terms and any service-specific conditions presented during ordering.
Accounts & Eligibility
Customers are responsible for providing accurate information necessary to create and maintain their account and for keeping account contact information reasonably current.
Customers are responsible for protecting login credentials, passwords, authentication methods and access to the customer account.
Activity performed through an account or service may be treated as authorized by the account holder unless OffshoreDedi is notified of unauthorized access.
If you believe your OffshoreDedi account, VPS, dedicated server or control panel has been compromised, contact support as soon as possible.
Service Availability & Provisioning
Services are subject to infrastructure, hardware, licensing, network and location availability.
Shared hosting and VPS services may be provisioned automatically or semi-automatically. Dedicated and specialized servers may require manual provisioning and are subject to available hardware inventory.
Deployment times shown on the website are estimates rather than absolute guarantees.
Where a specific server configuration, location or hardware component is unavailable, OffshoreDedi may contact the customer to discuss alternatives.
Customer Responsibilities
Customers are responsible for the content, applications, software and activity associated with services under their control.
Customers must take reasonable steps to secure their services and prevent unauthorized, abusive or illegal use.
This includes maintaining secure passwords, applying appropriate software updates and protecting hosted applications where the service is customer-managed.
Acceptable Use
OffshoreDedi provides offshore hosting and infrastructure intended for lawful websites, applications, media platforms, storage, development and other legitimate workloads.
Offshore hosting may provide additional jurisdictional choice, but it does not place customers or their services outside applicable law.
Customers may not use OffshoreDedi infrastructure in a way that creates unreasonable security, legal, operational or network risk for OffshoreDedi, its providers or other customers.
Prohibited Activities
The following activities are prohibited:
- phishing, credential theft or impersonation designed to obtain unauthorized information;
- malware, ransomware, viruses, trojans or malicious software distribution;
- fraud, scams or intentionally deceptive commercial activity;
- botnets or command-and-control infrastructure used for malicious activity;
- unauthorized access, intrusion attempts, vulnerability exploitation or compromise of third-party systems;
- denial-of-service attacks or deliberate participation in attacks against third parties;
- unsolicited bulk messaging or spam that materially affects network or IP reputation;
- child sexual abuse material, sexual exploitation of minors or other prohibited exploitative material;
- activity prohibited by applicable law at the location of the affected infrastructure;
- activity that causes serious or repeated disruption to OffshoreDedi infrastructure, upstream providers or other customers.
Services involved in phishing, malware, fraud, active network attacks or other serious illegal activity may be suspended immediately without prior notice.
Copyright, DMCA & Other Complaints
OffshoreDedi infrastructure is provided in jurisdictions outside the United States. Complaints are reviewed according to the location of the affected service, applicable local requirements, the nature of the complaint and these Terms.
Receipt of a United States DMCA notice does not automatically determine the outcome of a complaint where the affected infrastructure is located outside the United States.
Where a copyright-related complaint or notice from an appropriate local authority requires action, OffshoreDedi may notify the customer and request removal or correction of the reported material where circumstances allow.
Offshore hosting does not authorize unlawful activity, and OffshoreDedi may take action where required by applicable law or where a service violates these Terms.
Shared Hosting Resource Usage
Shared hosting is designed for websites that operate within the CPU, memory, I/O, process, storage and other limits assigned to the customer’s hosting plan.
Accounts that continuously exhaust shared server resources, materially affect other customers or operate workloads unsuitable for shared hosting may be restricted or asked to move to a VPS or dedicated server.
Shared hosting is not intended for sustained high-load background processing, network attack activity, uncontrolled bulk messaging or other workloads that materially interfere with the shared environment.
VPS & Dedicated Server Management
Standard VPS and dedicated server services are self-managed unless a separate management service is specifically included or purchased.
OffshoreDedi Responsibilities
OffshoreDedi maintains the underlying physical infrastructure, virtualization environment where applicable and network connectivity within the scope of the purchased service.
Customer Responsibilities
Customers manage operating-system security, software installation, applications, updates, configuration, licensing and backups on self-managed services.
Managed WordPress Hosting includes only the management and backup services described on the Managed WordPress Hosting product page.
Network & Bandwidth
Network capacity varies by service. Product pages describe the port speed, traffic model and bandwidth terms associated with each service.
An unmetered connection means that usage is not billed according to a monthly transfer quota. It does not mean that network capacity is infinite.
Actual throughput may be affected by routing, remote networks, protocol overhead, hardware performance, network conditions and other technical factors outside OffshoreDedi’s control.
DDoS & Network Protection
DDoS protection is not included by default unless specifically stated for a service.
Where traffic directed at a service causes or threatens significant network disruption, OffshoreDedi may apply temporary protective measures.
These measures may include traffic filtering, rate limiting, null routing, temporary network isolation or temporary suspension of the affected service.
Such action may be taken when reasonably necessary to protect network stability, infrastructure or other customers.
IP Addresses
IP addresses assigned with a service remain network resources associated with the service and are not transferred into customer ownership.
OffshoreDedi may change or reassign an IP address where reasonably necessary because of routing, network changes, abuse, reputation issues or operational requirements.
Customers may not use assigned IP addresses for spam, phishing, malicious activity or behavior that causes material network or reputation damage.
OffshoreDedi cannot guarantee that the external reputation of an IP address will remain unchanged indefinitely.
Backups & Customer Data
Unless a service explicitly states otherwise, customers are responsible for maintaining independent backups of important data.
RAID, storage redundancy, virtualization snapshots or other infrastructure redundancy should not be treated as a substitute for an independent backup.
OffshoreDedi is not responsible for data that is lost after a service has been terminated, recycled, reprovisioned or deleted.
Billing & Renewals
Services are billed according to the billing cycle selected during ordering and shown in the customer account.
Customers are responsible for paying invoices before or on the stated due date.
Renewal invoices may be generated before the service due date to provide customers with time to complete payment.
OffshoreDedi may change pricing for future orders or future billing periods where necessary. Where practical, material renewal price changes affecting an active service will be communicated before the affected renewal.
Overdue Services & Data Retention
Services may be suspended automatically when the associated invoice becomes overdue.
Dedicated Servers
An unpaid dedicated server may be terminated and the hardware released for other use approximately 3–4 days after becoming overdue.
VPS Services
Suspended VPS data may normally remain available for up to 30 days, but this retention period is not guaranteed. Suspended VPS instances may be permanently terminated earlier, including after approximately 10–15 days, when node capacity is required.
Customers should never rely on a suspended service as a method of data storage. Important data should be backed up before an invoice becomes overdue.
Shared hosting services may also be terminated after suspension. OffshoreDedi does not guarantee continued storage of data on unpaid or terminated accounts.
Refund Policy
Shared Hosting and VPS customers may request a refund within 48 hours of service activation if they are dissatisfied with the service.
Dedicated server payments are non-refundable because physical infrastructure is reserved or provisioned for the customer.
Domain registrations are non-refundable.
Third-party software and license charges are non-refundable. This includes license costs associated with services such as cPanel, LiteSpeed or other separately licensed software.
Where a Managed WordPress Hosting or VPS service includes a third-party software license, any eligible service refund does not include the non-refundable license cost.
Refund eligibility applies only to the refundable portion of an eligible Shared Hosting or VPS service. Domain and third-party license charges remain non-refundable.
Domain Registration & Domain Services
OffshoreDedi provides domain registration services through upstream registrar and registry relationships. OffshoreDedi is not the parent registry or underlying registrar for every domain extension offered.
Domain registrations, renewals, transfers and management remain subject to the policies and technical requirements of the relevant upstream registrar and registry.
A domain may be suspended, restricted or otherwise affected by an upstream registrar or registry where required by its policies, applicable rules or legal requirements.
OffshoreDedi cannot override a suspension or restriction imposed directly by the applicable parent registrar or registry where OffshoreDedi does not control that decision.
Domain registrations are non-refundable, including domains purchased together with a Shared Hosting package.
Software & Third-Party Licenses
Certain services may include or support third-party software such as operating systems, control panels, web servers or other licensed products.
Use of third-party software may be subject to separate licensing terms imposed by the software provider.
Customers are responsible for maintaining appropriate licenses for software they install themselves.
Third-party license charges purchased through OffshoreDedi are non-refundable once the license has been provisioned or billed to OffshoreDedi.
Security & Compromised Services
Customers operating self-managed servers are responsible for securing their operating system, applications, control panels, credentials and hosted software.
Where OffshoreDedi reasonably believes that a service has been compromised or poses an immediate security risk, temporary restriction or suspension may be applied while the issue is investigated.
OffshoreDedi may request that the customer reinstall, secure or otherwise remediate a compromised service before full access is restored.
Service Availability & Maintenance
OffshoreDedi aims to provide reliable hosting infrastructure but does not guarantee that a service will operate without interruption at all times.
Services may be affected by scheduled maintenance, emergency maintenance, hardware failure, network incidents, software issues, upstream-provider events, attacks or events outside reasonable control.
Where practical, planned maintenance that is expected to materially affect a service may be communicated in advance.
Suspension & Termination
OffshoreDedi may suspend or terminate a service where reasonably necessary because of:
- non-payment;
- serious or repeated violation of these Terms;
- phishing, malware, fraud or malicious activity;
- active attacks or serious network abuse;
- security threats or compromised services;
- legal or regulatory requirements applicable to the service;
- material interference with network stability;
- repeated unresolved abuse complaints;
- threatening, abusive or seriously harassing conduct toward OffshoreDedi staff;
- other material breaches of the service agreement.
Serious security or illegal-activity cases may be suspended immediately without advance notice.
For less urgent matters, OffshoreDedi may provide notice and an opportunity to resolve the issue where circumstances reasonably allow.
Customer Cancellation
Customers may request cancellation through the customer account system or another cancellation method made available by OffshoreDedi.
Customers are responsible for downloading or backing up required data before the cancellation or termination date.
Once a service is terminated and its storage is released or reprovisioned, data recovery may no longer be possible.
Limitation of Liability
To the extent permitted by applicable law, OffshoreDedi is not responsible for indirect, incidental, special or consequential losses arising from the use or inability to use a service.
This may include loss of profits, loss of business opportunities, loss of data, interruption of service or losses caused by third-party software, networks or services.
Customers remain responsible for maintaining appropriate backups and business continuity arrangements suitable for the importance of their workload.
Nothing in these Terms excludes liability that cannot lawfully be excluded under applicable law.
Indemnification
To the extent permitted by applicable law, customers are responsible for claims, losses or costs arising from their unlawful use of OffshoreDedi services, material violation of these Terms or infringement of third-party rights caused by content or activity under their control.
Force Majeure
OffshoreDedi is not responsible for delays or failure to perform caused by events outside reasonable control.
Such events may include major network failures, upstream-provider outages, natural disasters, war, civil disruption, government action, power-grid failures, large-scale cyberattacks, datacenter emergencies or similar events that cannot reasonably be prevented.
Privacy
Personal information associated with customer accounts, orders, payments, support requests and website use is handled in accordance with the OffshoreDedi Privacy Policy.
The current Privacy Policy is available at:
Changes to Services or These Terms
OffshoreDedi may update these Terms from time to time to reflect changes in services, infrastructure, abuse handling, billing, legal requirements or operational practices.
The updated version will be published on this page with a revised “Last updated” date.
Where a material change requires additional notice, OffshoreDedi may provide notice through the website, customer account or another appropriate communication method.
Applicable Law & Infrastructure Location
OffshoreDedi provides infrastructure in multiple locations. Matters relating directly to hosted content, network activity, abuse complaints or server operation may be assessed according to the location of the affected infrastructure and the laws or requirements applicable to that location.
Different services and infrastructure locations may therefore be subject to different local legal or operational requirements.
Nothing in these Terms should be interpreted as a promise that any customer, website, server or activity is exempt from applicable law.
